  6. I don’t know why anyone is surprised by this. International court ruling means absolutely nothing to powerful nations. When the International Court of Justice ruled that the US has to pay reparations to Nicaragua for arming & training a group of genocidal rebels and mining (the explosive kind) Nicaragua’s harbors in order to cripple their economy, the US basically told the court to fuck off. When the Permanent Court of Arbitration ruled against China’s claim in the South China Sea, China and to a lesser degree Taiwan basically told the court to fuck off. When the International Court of Justice ruled the UK have to return the Chagos Islands (home to US’s Diego Garcia base) back to Mauritius, UK basically told the court to fuck off. Major power’s response to these international court rulings can be summarized as such: 1) If the ruling is beneficial to me or hurts my rival or competitor, than the country will declare the ruling as just, unbiased, the court has jurisdiction regarding the issue and the various parties need to follow the courts rulings. and 2) If the ruling is not beneficial or is beneficial to a rivil or competitor, than the country will hurl a long list of insults toward the court and the ruling, usually about the court not being legitimate, has no jurisdiction over the case, it’s some sort of biased kangaroo court and the ruling will be ignored.

  13. This comes up every time anything about the ICC and the USA is posted.

    The USA never signed the ICC’s founding charter, along with half of the world (including Russia and China). This means the US does not consider the ICC binding, and would be naturally upset if the ICC imprisoned American citizens.

    Basically, complain that America didn’t sign the Rome Statute, don’t complain that America isn’t adhering to a Statute it did not sign.

    If you ask why America never signed the thing, you get an interesting answer. It isn’t constitutional for any American government to place a Court (like the ICC) above the US Supreme Court. So American governments are barred from agreeing to ICC jurisdiction.

    Don’t get mad about stuff, and ask “are we the baddies?” simplistically. Learn about the context, then get emotional. Or not.
